For the State The petitioner has challenged the proceedings of Contai P.S. Case No. 217 of 2014 dated 19.6.2014 along with the orders passed therein.

The petitioner is directed to serve a copy of this revisional application upon Mr. Arijit Ganguly, Learned Advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authority. So far as the prayer for quashing of the proceedings is concerned, the same cannot be accepted by this Court, since the petitioner was evading the process of law. However, the Learned Advocate submits that the petitioner intends to surrender before the Learned jurisdictional Court.

To that effect, the Learned Advocate has referred to the order dated 10.5.2023, which reflects that execution return of warrant of arrest is still pending.

Considering the submission of Learned Advocate for the petitioner that the petitioner intends to surrender before the Learned Jurisdictional Court, I direct that in case the petitioner surrenders before the Learned Jurisdictional Court, the Learned Jurisdictional Court, on such surrender, would consider the application for bail of the petitioner in accordance with law.

With the aforesaid observation CRR 2789 of 2023 is disposed of.

Pending application, if any, is also disposed of. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
