Ms. Papiya Chattopadhyay ... for the petitioners This application under Article of the Constitution of India is at the instance of the plaintiffs praying for a direction upon the learned Civil Judge (Junior Division), 2nd Court at Barasat to dispose of Title Suit No. 121 of 2010 expeditiously.

The learned advocate appearing for the petitioners submits that the suit was initially filed before the learned Civil Judge (Junior Division), 1st Court at Barasat and subsequently the same has been transferred to the court of the learned Civil Judge (Junior Division), 2nd Court at Barasat pursuant to an order passed by this Hon'ble Court.

The learned advocate appearing for the petitioners submits that after the suit has been transferred to the court of the learned Civil Judge (Junior Division), 2nd Court at Barasat no date has been fixed in the said suit. In view of the order sought and proposed to be passed, there is no necessity to issue notice upon the opposite parties.

However, the learned advocate appearing for the petitioners shall be obliged to forward a

copy of this application along with this order upon the opposite parties or upon the learned advocates representing them before the learned trial judge. In the light of the submissions made by the learned advocate for the petitioners, C.O. 2847 of 2025 stands disposed of by giving liberty to the petitioners to approach the learned Civil Judge (Junior Division), 2nd Court at Barasat by making an appropriate application for fixing a date in the said suit. The learned trial judge is requested to make an endeavour to dispose of the Title Suit No. 121 of 2010 expeditiously if the same is otherwise ready for hearing.

There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
