The contempt application is taken up for consideration in presence of the learned advocates representing the applicant and alleged contemnor. It has been submitted on behalf of the alleged contemnor that Rs.4,39,000/- has been paid on 6th March, 2024 to the applicant pursuant to the direction as contained in the order dated 10th May, 2023. Therefore, according to the alleged contemnor grant of benefit of refixation of pay as directed by the coordinate Bench is complied with. However, direction relating to issuance of revised Pension Payment Order as directed by the coordinate Bench vide order dated 10th May, 2023 has not yet been complied with. As per norms the Pension Payment Order is issued by the Director of Pension Provident Fund and Group Insurance.

However, in the contempt application the said authority has not been arrayed as alleged

contemnor.

Leave is granted to the learned advocate representing the applicant to amend the cause title of the contempt application and add Director of Pension Provident Fund and Group Insurance, West Bengal as additional alleged contemnor in course of this day.

After the amendment is carried out the learned advocate for the applicant is directed to serve notice enclosing copy of the order passed by this Court and contempt application upon the added alleged contemnor by ten days from date and file affidavit-of-service on the adjourned date. List the contempt application under the same heading for further consideration in the monthly combined list of April, 2024.

Documents filed in support of payment made in favour of the applicant are taken on record.
