Datta ..........for the State The present application under Section 439 of the Code of Criminal Procedure has been preferred by the petitioner in connection with Technocity P.S. Case No. 51 dated 20.05.2021 under section 21(c) of the NDPS Act.

Heard the learned advocates for the respective parties and considered the materials in the case diary. It appears that contraband substance above commercial quantity was recovered from the possession of the petitioner and in view thereof, the rigors of Section 37 of the NDPS Act are attracted. As such, the prayer of the petitioner is refused at this stage. The application being CRM 7914 of 2021 is dismissed. However, it appears that the petitioner is in custody for about 210 days and in view thereof, learned Court below is directed to take expeditious steps to conclude the trial as early as possible without granting any unnecessary adjournments to either of the parties.
