Learned counsel for the West Bengal State Electricity Distribution Company Limited (WBSEDCL) contends, while reiterating the earlier submissions made on behalf of the Distribution Licensee, that due to objection and obstruction raised by the added respondent and his men and agents, the WBSEDCL could not give electricity connection to the petitioner despite the petitioner having deposited the quotation money.

Since good service has been effected on the added private respondent, but the said private

respondent chooses not to be represented today when the matter is called on for hearing, the matter is taken up for disposal in the absence of the private respondent.

Affidavit-of-service filed in Court today be kept on record.

In the circumstances as discussed above, WPA No. 18432 of 2022 is disposed of by directing the WBSEDCL to give new electricity connection to the petitioner in terms of the petitioner's application as expeditiously as possible, positively within three weeks from date. In the event the WBSEDCL personnel are obstructed by the private respondent and his men and agents in doing so, it will be open to the WBSEDCL officials to approach the respondent no. 4, the Officer-in-Charge, Kotulpur Police Station, for adequate police assistance in that regard.

If so approached, the respondent no. 4 shall act on the written communication of the learned Advocate appearing for the petitioner, accompanied by a server copy of this order, without insisting upon prior production of a certified copy thereof, for the purpose of compliance of this order and grant such

assistance to the WBSEDCL personnel at the cost of the petitioner.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
