Mr. Dyutiman Banerjee Mr. Sourat Nandy ..for the petitioners Mr. Alok Kumar Ghosh Mr. Swapan Debnath ..for the KMC The petitioners challenge a demolition proceeding in respect of a building at 38B (Portion), Pulin Khatik Road, Ward no.58, Tangra, Brough-VII, Kolkata-700015.

Mr. Ghosh, learned advocate appearing for the Kolkata Municipal Corporation has drawn attention of this Court to an order dated July 16, 2024 passed in WPA 12102 of 2023 whereby a Co-ordinate Bench of this Court has passed a direction for demolition of the relevant building.

Learned advocate appearing for the petitioners, however, submits that the petitioners are not aware of any such order. Copy of that writ petition was never served upon him.

I am of the view that if any order, as prayed for in this writ petition, is passed, the same will be an

interference with the order dated July 16, 2024 passed in WPA 12102 of 2023.

Accordingly, WPA 18722 of 2024 is dismissed.

I, however, make it clear that the dismissal of this writ petition shall not prevent the petitioners from taking appropriate steps, if they are aggrieved by the order dated July 16, 2024.

Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
