Mr. Sounak Mondal Mr. Bijoy Bag Mr. Goutam Malik ... for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Junior Division), 3rd Court at Howrah to dispose of the injunction application filed by the petitioner under Order 39 Rule 1 and 2 of the Code of Civil Procedure in Title Suit No. 954 of 2025 expeditiously.

From the ordersheets appended to this application this Court finds that the suit was filed on 2nd July, 2025 and the learned trial judge by an order dated 2nd July, 2025 refused to pass an ad interim order of injunction as a caveat was lodged. The petitioner thereafter prayed for preponment of the date of hearing and the hearing of the injunction application was fixed on July 28, 2025. The learned advocate appearing for the petitioner submits that on 28th July, 2025 the written objection to the injunction application has been filed and 9th September, 2025 has been fixed for hearing of the injunction application.

Considering the fact that the suit was filed only on 2nd July, 2025, this Court is not inclined to pass any direction for expeditious hearing at this stage. C.O. 2835 of 2025 stands disposed of with the hope and trust that the learned Civil Judge (Junior Division), 3rd Court at Howrah shall make an endeavour to dispose of the injunction application expeditiously. There shall be, however, no order as to costs. Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
