1. This appeal is preferred against the judgment and order dated 25.03.2009 passed by the Learned Metropolitan Magistrate, 13th Court, Calcutta in T.R. No. 292 of 2002, which corresponds to Case No. C-1320 of 1997, thereby acquitting the accused/respondents of the charge under Sections 138/141 of the Negotiable Instruments Act.

2. Learned Advocate for the appellant has filed a written instruction from the appellant seeking permission to withdraw the instant criminal appeal. The prayer is allowed.

3. Accordingly, the instant criminal appeal is dismissed as withdrawn.

4. Lower court records along with a copy of this judgment be sent down at once to the Learned Trial Court for necessary action.
