APP Mr. Pravas Bhattacharya Mr. Dipankar Paramanick .....For the State Apprehending arrest in connection with Palashipara Police Station Case No. 323/2021 dated 18.08.2021 under Sections 341/326/307/34 of the Indian Penal Code, the present application has been preferred.

Mr. Bagchi, learned advocate appearing for the petitioner submits that the petitioner has been falsely implicated. She is a lady and there is no possibility that she would flee from justice or delay the trial by abscondence. The allegations are omnibus in nature and upon completion of investigation, charge sheet has already been submitted and as such, custodial interrogation is not warranted.

Mr. Sur, learned Additional Public Prosecutor appearing for the State opposes the petitioner's prayer and draws our attention to the statements of the witnesses as recorded under Sections 161 and 164 of the Code.

Heard the learned advocates appearing for the respective parties and considered the materials in the case diary. Prima facie, there are strong incriminating materials against the petitioner. Considering the gravity of the offence, the nature of accusations, the injury report, the medical documents and the extent of complicity of the petitioner in the alleged offence, we are not inclined to exercise any discretion in her favour. Her prayer for anticipatory bail is rejected. The application CRM 7918 of 2021 is, accordingly, dismissed.
