13.12.2021 sb CRR 2401 of 2021 (Via video conference) In the matter of : Year Ali Mondal .......Petitioner Mr. Nemai Ray ...for the petitioner Mr. Mirza Firoj Ahmed Begg....for the State Learned advocate for the petitioner is aggrieved by the manner in which the proceedings are progressing before the learned trial Court. Learned advocate further submits that in spite of earlier direction passed by this Court in CRR 1773 of 2020, there has been no progress in the case. Learned advocate for the State is present.

It would not be out of place to state that for a substantial period in the year 2021, the Courts operated in a staggered manner as such it was not possible for the trial Court to adhere to the guidelines laid down by this Court as the situation was beyond the control of the trial Court.

However, having regard to the fact that presently the normal functioning of the court has resumed, I direct the learned trial Court to keep in mind the period of detention of the present petitioner and adhere to the mode and manner of disposal of the present case which should be preferably by 31st January, 2023.

With the aforesaid observations, CRR 2401 of 2021 is disposed of.
