Learned advocate appearing for the petitioner is directed to serve a copy of this revisional application upon Mr. Mirza Firoj Ahmed Begg, learned advocate, who ordinarily appears for the State. His appointment may be regularised by the concerned authorities.

Learned advocate appearing for the petitioner submits that the petitioner is in custody since 24.11.2021. Chargesheet has already been filed and charge has already been framed. Learned advocate submits that till date no witness has been examined in spite of charge being framed. The petitioner is in custody for about 20 months. As such, the anxiety expressed by the petitioner is justified. Accordingly, the learned special court is directed to expedite the progress of the trial by fixing schedule consisting of three dates and fix such schedule once in every two months so that trial of the case can be taken to its logical conclusion within a reasonable period of time. No unnecessary adjournment should be granted to either of the parties.

Learned public prosecutor conducting the case would produce all materials, exhibits and documents on the date so fixed for examination of the witnesses.

If the learned special court finds that any of the government or departmental witnesses are not appearing, immediately notice be issued upon the office of the Superintendent of Police of the concerned district so that effective steps may be taken for appearance of the witnesses. All stakeholders would cooperate with the learned trial court for concluding the trial of the case at the earliest. With the aforesaid observations, the revisional application being CRR 2978 of 2022 is disposed of. Pending connected application, if any, is consequently disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
