The revisional application is disposed of as the same has now become infructuous. The records of Matrimonial Suit No.2716 of 2023, which is pending before the learned District Judge, South 24 Parganas, has been traced out. The learned District Judge, by order dated August 31, 2023 has fixed the suit on September 28, 2023 for appearance of the parties.

Thus, the learned District Judge is directed to proceed with the suit and all proceedings connected thereto, expeditiously and strictly in accordance with law. It is expected that the entire proceeding shall be disposed of within a year from the date of communication of this order.

The apprehension of Mr. Ray, learned advocate for the wife that the suit will be proceeded without giving an opportunity to the wife to file an application for maintenance pendente lite, is misconceived as the wife always has a right to file such application. Such application, if filed will be decided of by the learned District Judge on merits.

Accordingly, the revisional application is disposed of. All the parties are directed to act on the basis of the server copy of this order.
