22.11.2022 KC(67) F.M.A.T. 322 of 2022 Shyam Sundar Paul -versusSankita Paul and Ors.

With CAN 1 of 2022 Mr. Biswajit Chatterjee, Mr. Sanjib Kumar Mukherjee, Md. Sukur, Ms. Nargis Parvin........................For the appellant. Mr. Amitabrata Ghosh, Ms. Nabanita Chatterjee...............For the respondents. We admit the appeal.

Dispensing with all formalities we are disposing of it by this judgment and order.

The impugned ex parte interim order was passed by the learned court below on 19th May, 2022. The application was returnable on 17th June, 2022. This appeal has been filed around the end of August or first week of September, 2022.

Hence, there is little justification for hearing of the matter by us. On the contrary, it is necessary that the interim application is heard out by the learned court below by fixing another date for hearing thereof and disposing of the same on hearing the parties by a reasoned order within eight weeks from the date of communication of this order.

We order accordingly.

All points are kept open before the learned court below.

Learned counsel for the respondents prays for an order directing the matter to be sent for mediation. He is at liberty to renew such prayer before the learned court below.

The appeal (F.M.A.T. 322 of 2022) and the connected application (CAN 1 of 2022) are disposed of. (I.P. MUKERJI, J.) (BISWAROOP CHOWDHURY, J.)
