Learned counsel appearing for the petitioner submits that the local police authorities have been interfering with the lawful business of the petitioner and have been demanding illegal gratification to allow the trucks to pass after inspection.

Learned counsel appearing for the State files a report. Let the report be kept with the record. From the report it is alleged that one Sri Dilip Prasad, Area Security In-charge, Salanpur Area ECL lodged a complaint at Barbani Police Station vide Barabani P.S. Case No. 67 of 2024 dated 04.05.2024 against one Bikash Pandey, the driver of a truck bearing no. WB37D 7767 for carrying illegal coal. The ASI, Netai Samadder of Barbani P.S was entrusted with the investigation of the case.

From the investigation it came into light that the said vehicle was

being loaded with illegal coal at Maa Bhayrabi Briquette Coke Industries, owned by the petitioner.

Heard parties at length and perused the writ petition and the report filed by the State.

The authorities shall investigate the Barbani P.S. Case No. 67 of 2024 in accordance with law but so long as the petitioner carries on business lawfully, there shall be no interference by the police authorities. With the above observation, the writ petition being WPA 18797 of 2024 is disposed of.

There shall be no order as to costs.

All parties shall act upon the server copy of this order duly downloaded from the official website of this Court.
