The present revisional application has been preferred for quashing of the proceedings arising out of Pursurah Police Station Case No.57 of 2018 dated 01.05.2018.

Ms. Faria Hossain, learned advocate appearing for the State has submitted a list of dates in the form of report which reflects that the next date has been fixed for evidence of CSW1 on 09.10.2023. Let the report be kept with the record. There are 18 witnesses to be examined in this case. Learned advocate for the petitioner has mainly emphasised on the issue that the mother of the victim has been made an accused in the present case.

Learned advocate for the State has confronted such contentions and submitted that the records reflect her complicity and prima facie a case being made out. As such, she has been made an accused and not a witness of the present case. Having regard to such submissions, I am of the opinion

that at this stage there is no scope for interference in respect of the merits of the case.

The evidence has commenced. As there are 18 witnesses, I direct the learned trial court to fix a schedule of at least four dates and fix such schedule once in every 45 days so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. In case any witness is absent, the SDPO/DSP of the concerned Sub-Division would in response to any communication made from the court ensure regarding the presence of the witnesses' concerned. So far as the prayers so advanced before this Court, the same is not interfered with.

With the aforesaid observations, CRR 2980 of 2022 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
