The facts of the present case are succinctly stated in the order dated May 5, 2022 passed in WPA 3890 of 2022 filed by the petitioner.

In compliance of the direction passed by the Court a spot inspection was conducted in presence of the petitioner as well as the private respondent. At the time of inspection it transpired that the construction was being made without any sanctioned plan.

The learned advocate representing the private respondent is unable to satisfy the Court that the construction has been made in accordance with any plan sanctioned by the Bidhannagar Municipal Corporation. In view of the above, the Bidhannagar Municipal Corporation is directed to take steps strictly in terms of the direction passed by the Court on May 5, 2022. The Bidhannagar Municipal Corporation is directed to keep strict vigil over the premises to ensure that no construction is carried out at the premises till a decision is taken by the Bidhannagar Municipal Corporation. The writ petition stands disposed of.
