Versus

Prof. Md. Osman Ghani The matter appeared in the warning list on 29th November, 2022 and thereafter transferred to the regular list on 5th December, 2022. There was a clear indication in the list that the matter shall be transferred to the daily cause list on 5th December, 2022 and since then the appeal is appearing in the list. The appellants are not represented nor any accommodation is prayed for on behalf of the appellants. The appeal is of the year 2010.

The appeal is defective. On 12th September, 2011, a coordinate Bench noticing such defects adjourned the matter for one week after reopening of the court after long vacation for the year 2011 in order to enable the appellants to remove the defects and in default, put up for final order.

Since then the department did not list the matter before the Division Bench. The defects have not yet been removed. The second appeal stands dismissed for non-removing the defects.
