Petitioner is aggrieved by the fact that in spite of a decree having been passed by the Civil Court in TS No. 108/2017 by the learned Civil Judge (Junior Division), 1st Court, Arambagh, petitioner is unable to raise construction as there has been interference with the said property at the behest of certain unknown local miscreants. To that effect, information was furnished before the police authorities, but no steps have been taken. Report submitted by the police authorities reflect that police authorities on receipt of such information has drawn up proceedings under section 126/135 BNSS on two occasions i.e. on 11.05.2025 as also on 15.06.2025. Having considered that in quick succession, two proceedings have been drawn up, one at the behest of the petitioner and another against the

petitioner, I am of the view that police authorities are well aware regarding the existing issue.

Consequently, I direct that the police authorities will interfere as and when there will be violation of law and order. So far as the other issues are concerned, petitioner would approach the jurisdictional Magistrate for necessary relief.

With the aforesaid observations WPA 18041 of 2025 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
