The order proposed to be passed in the present application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present application upon the said opposite party is dispensed with.

The plaintiff in a suit for declaration and permanent injunction being Title Suit No. 689 of 2024 is the petitioner of the instant application under Article 227 of the Constitution of India. The petitioner is complaining delay in disposal of the application for injunction filed by him in the said suit.

The application was filed on July 05, 2024, as such, at this stage the direction as prayed for is unwarranted.

However, in view of the nature of the application, the learned Trial Judge shall make all endeavour to dispose of the said application in accordance with law expeditiously, when the same would be ready for such disposal.

C.O. 2641 of 2024 is disposed of with the above terms without any order as to costs.

Urgent photostat certified copies of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
