In Re: An Application under Section 482 read with Section 401 of the Code of Criminal Procedure.
The present revisional application has been preferred against the order dated 27.07.2011 passed by the learned Judicial Magistrate, Haldia, Purba Medinipur in connection with Misc. Case No. 25 of 2008 under Section 125 of the Code of Criminal Procedure wherein the learned Magistrate was pleased to direct the husband to pay a sum of Rs.1500/- per month as maintenance to the wife and Rs.1000/- per month as maintenance to the minor daughter. It reflects from the said order that the learned Magistrate, on appreciation of the materials available before him and on thorough consideration of the capacity of the husband, came to the aforesaid findings regarding the quantum of maintenance.
Having regard to the issues, which have been canvassed in this revisional application, I am of the view that the quantum of amount is so meagre that the same does not call for any interference at this stage after almost ten years of the order being passed. As such, no interference is called for. Accordingly, the revisional application being CRR 2973 of 2011 is dismissed.
Interim order, if any, is hereby vacated.
All pending applications, if any, are consequently disposed of.
