The petitioner was the Headmistress of Beleghata Deshbandhu Girls' High School and on superannuation, has retired from her said service on November 30, 2020 but till date, she has not received her retiral benefits.

The delay in disbursement of the said retiral benefits has been caused due to the nonissuance of the 'No-Liability Certificate' from the school authority.

Mr.

Soumen Bandyopadyay, learned advocate for the school authority files the written instruction dated October 07, 2023 recevied by him from the present Headmistress of the school, the said instruction does not indicate any objection with regard to issuance of the required 'No-Liability certificate'. Let the said instruction be kept with record.

Learned advocate for the State submits that the pending audit of the school is complete.

In the absence of any specific objection in issuing the said 'No-Liability certificate', the School authority is obliged to issue the said certificate, accordingly the said authorities are directed to issue it enabling the concerned respondents to take steps for disbursement of the retiral benefits including the pension of the petitioner.

W.P.A. 19162 of 2021 is disposed of with the above terms without any order as to costs. Urgent photostat certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
