It appears therefrom that there has been massive deviation and unauthorised construction made at both the premises, that is, 82 and 82/1, Cowies Ghat Road. In the premises no. 82, the unauthorised constructed area is approximately 2664 sq feet and in premises no. 82/1, the unauthorised portion is approximately 2785 Sq feet. Learned advocate for the private respondents submits that as-made plan has been filed before the HMC seeking regularisation of the construction made. The instant writ petition is disposed of by directing the Municipality Commissioner, HMC or his delegate to

take necessary steps to deal with the unauthorised construction in accordance with law after giving a reasonable opportunity of hearing to all the necessary parties.

Effort shall be taken to conclude the proceeding in accordance with law, at the earliest, but positively within a period of twelve weeks from the date of communication of this order.

The writ petition stands disposed of.

Inspection report filed by the HMC be retained with the records.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
