Mr. Tanmoy Mukherjee ...for the petitioner This application under Article of the Constitution of India is at the instance of the plaintiff praying for a direction upon the learned Civil Judge (Sr. Div.), 7th Court at Alipore to dispose of Title Suit No.21 of 2019 expeditiously.
Mr. Mukherjee, learned advocate appearing for the petitioner submits that several interlocutory applications at the instance of the plaintiff as well as the defendant are pending. He further submits that September 24, 2025 has been fixed for hearing of all the applications. He further submits that all the interlocutory applications are otherwise ready for hearing.
In view of the order sought and proposed to be passed there is no necessity to direct issuance of any notice upon the opposite party. However, the learned advocate for the petitioner shall be obliged to forward a copy of this application along with this order upon the opposite party or the learned advocates representing the opposite party before the learned trial judge.
From the order sheets appended to this application, this Court finds that by an order dated June 30, 2025, the learned trial judge has fixed September 24, 2025 for hearing of all the applications.
In the light of the submission made by the learned advocate for the petitioner, CO 2846 of 2025 stands disposed of by requesting the learned Civil Judge (Sr. Div.), 7th Court at Alipore to make an endeavour to dispose of the pending interlocutory applications filed in Title Suit No.21 of 2019 as expeditiously as possible without granting any unnecessary adjournments to either of the parties.
It will be open to the learned trial judge decide which of the application shall be taken up first.
There will be no order as to costs.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
