16.09.2025 Item No.11 Ct.No.34 rc.

Reject C.R.M. (M) 1308 of 2025 In Re : An Application for bail under Section 439 of the Code of Criminal Procedure read with Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Sutahata Police Station Case No. 335 of 2023 dated 19.03.2023. And In Re :

Rafikul Sahaji @ Sofikul Sahaji ... Petitioner Mr. Debapriya Majumder ... for the Petitioner Mr. Antarikhya Basu Mr. Asraf Mandal ... for the State Heard learned counsels for the parties.

The petitioner is in custody for more than two years and renews his prayer for bail.

Learned counsel for the State opposes the prayer. Bail prayer of the petitioner was turned down by this Court on March 18, 2025 considering the material on record as well as the fact that the prosecution was not responsible for the delay in progress in trial. The accused persons on bail filed several adjournment petitions before the learned trial Court which delayed commitment of the case.

This Court is informed that the case has been committed and date has been fixed for consideration of charge.

Considering the fact that sufficient incriminating material has transpired against the petitioner and the motorcycle used for commission of dacoity as well as stolen cash was recovered from his possession, this Court is inclined to hold that the petitioner does not deserve any favourable order at this stage.

Accordingly, the prayer for bail is rejected at this stage.

The learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.

The bail application is disposed of.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
