Learned counsel for the petitioner contends that the petitioner's application for new electricity connection has not been processed as incomplete.

By placing reliance on the writ petition, the supplementary affidavit filed today and the annexures thereto, it is submitted that all relevant documents were actually furnished before the West Bengal State Electricity Distribution Company Limited (WBSEDCL) at the relevant juncture.

However, learned counsel for the WBSEDCL submits that certain necessary documents were not produced, for which the application has not yet been processed.

Learned counsel appearing for the respondent no. 4, in his usual fairness, submits that the electricity connection as sought may be given to the petitioner, however, subject to compliance of all formalities by the petitioner. Upon hearing learned counsel for the parties, WPA No. 18504 of 2022 is disposed of by granting liberty to the petitioner to apply afresh for a new electricity connection in appropriate format and with all requisite documents within a week from date. If so applied, the WBSEDCL shall process the same and, subject to compliance of all due formalities by the petitioner, give such connection to the petitioner within a fortnight from compliance of such formalities.

The learned Advocate appearing for the WBSEDCL shall communicate to his counterpart appearing for the petitioner in writing by September 12, 2022 as regards what are the omitted documents in the application for new connection to enable the petitioner to comply with all formalities properly.

It is, however, clarified that merely by giving electricity connection in favour of the petitioner, no special right and/or equity shall be created or conferred in favour of the petitioner. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
