State of West Bengal & Ors.
Ms. Nibedita Pal, Ms. Sonam Ray ...... for the petitioner.
Mr. Swapan Kr. Dutta, Ld. Sr. Adv. & AGP, Mr. Rajat Dutta ......for the State respondent.
Affidavit-of-service filed on behalf of the petitioner is taken on record.
Petitioner is the daughter-in-law of one led Satyendra Nath Dutta who was an erstwhile MR Dealer.
Petitioner applied for licence on compassionate ground, in terms of his application a hearing was conducted by the concerned Director, DDPS on 15th day of January, 2025. Since then, no result of such hearing was communicated to the petitioner.
Petitioner made a representation to the authority on 15th of May, 2025 it was not considered; hence this writ.
Mr. Swapan Kr. Dutta, learned senior counsel appearing on behalf of State submits that the representation made by the petitioner to the
concerned authority on 15th of May, 2025 may be directed to be considered by the authority.
Having heard the learned counsels for the parties; it appears that the petitioner has applied for licence on compassionate ground by making an application on 18th March, 2024. In terms of his application he was given hearing on 15th day of January, 2025. Since then, the authority concerned has not taken a decision. The petitioner has filed a representation on 15th May, 2025 that also not considered.
Considering the same, I think it necessary to pass a necessary direction upon the concerned authority to settle out the issue. Accordingly, the instant writ petition is disposed of with a direction to the Director, DDPS, Food and Supplies Department, Government of West Bengal, being respondent No. 2 of the writ petition to intimate the result of hearing conducted by him on 15th day of January, 2025 to the petitioner within three weeks from the date of communication of this order, most preferably before the ensuing Puja Vacation.
Under the above observations, the instant writ petition is disposed of.
As the affidavits are not exchanged, the allegation made herein shall be deemed to have been not admitted.
