The revisional application has been preferred praying for transfer of Matrimonial Suit No. 103 of 2020, from the Court of learned Additional District and Sessions Judge (S), Fast Track, 1st Court, Sealdah, South 24 Parganas to the file of the Court of learned District Judge, Paschim Medinipur.

It is submitted by the learned counsel for the petitioner that several cases are pending before the courts in Paschim Medinipore and the opposite party/husband is contesting the same. Admittedly, parties do not have any children. 3.

It is submitted that if the opposite party/husband can pursue his profession and

contest the other cases at Paschim Medinipore, then the prayer for transfer should be allowed. 4.

An affidavit-in-opposition has been filed by the opposite party/husband wherein at Page-8 is a copy of the disability certificate.

It appears from the said certificate that the husband-opposite party is 100 (hundred)% blind and the certificate has been issued by a valid medical board. As such his case has to be considered sympathetically.

Considering the said facts and circumstances, this Court finds that it will not be convenient for the opposite party/husband in the present case, to attend Court at Paschim Midnapore and his convenience in the present case is paramount.

Accordingly, the revisional application being C.O. 2648 of 2024 having no merit, stands dismissed.

In case petitioner/wife herein prays for appearing virtually during trial in the present

case, the Trial Court shall permit the same in accordance with law.

Urgent Photostat Certified copy of this order, if applied for, be supplied to the parties subject to compliance with all requisite formalities.
