Report submitted by the learned advocate appearing for the State be also kept with the record. Petitioner is aggrieved by the inaction of the police authorities as the information which was furnished did not yield any result.
Mr. Das, learned advocate appearing for the private respondent no.7 submits that suit for specific performance of contract being T.S. No. 536 of 2022 has already been preferred before the learned Civil Judge (Senior Division), 3rd Court, Barasat.
State has submitted a report which reflects that Rahara P.S. Case No. 226 of 2025 dated 10.08.2025 has been registered for investigation against the private respondent nos. 5 to 7 herein.
Having considered that the police authorities have already taken steps and there is dispute between the petitioner and the private respondents relating to agreement/property, I am of the view that further interference of this Court is uncalled for. Police authorities will take the investigation of the case so registered to its logical conclusion within a reasonable period of time.
If the petitioner feels insecure, he will take out appropriate application before the learned Magistrate in seisin of the criminal case. Learned Magistrate would assess regarding the genuinity of the same and pass necessary orders in accordance with the provisions of law.
With the aforesaid observations, the writ petition being WPA 17968 of 2025 is disposed of. There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
