1. Learned counsel for the petitioner contends that the petitioner applied for new electricity connection, which was not given by the West Bengal State Electricity Distribution Company Limited (WBSEDCL).

2. Learned counsel for the WBSEDCL, pursuant to assurance given to the court on October 10, 2023, hands over a photocopy of a communication dated March 31, indicating that the petitioner is already enjoying electricity connection at the premises and the WBSEDCL apprehends splitting up of load in the event any new connection is given at the same premises. The said photocopy is kept on record.

3. Learned counsel for the petitioner disputes that the petitioner has received any such communication.

4. Be that as it may, since an objection as to apprehended splitting of load has been taken by the WBSEDCL, which has to be decided by the competent forum in law, that is, the Grievance Redressal Officer (GRO), this Court chooses not to interfere at this juncture.

5. WPA No. 18113 of 2023 is disposed of with liberty to the petitioner to approach the concerned GRO with the disputes as raised herein. If such an approach is made, the GRO shall decide such issues between the parties in accordance with law upon giving adequate opportunity of hearing to all concerned at the earliest, preferably within November 30, 2023.

6. There will be no order as to costs.

7. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
