Learned advocate for the petitioner submits that the petitioner is in custody for 41 days and further detention of the petitioner is unwarranted as the police has effectively completed the investigation in connection with the instant case. Learned advocate for the State opposes the prayer for bail and submits that the petitioner happens to be the husband who had inflicted continuous mental and physical torture upon the victim.

I have perused the materials on record including the fact that the marriage was solemnised five years prior to the registration of the FIR. However, having regard to the period of detention of the petitioner, I am of the view that further detention of the petitioner is unwarranted in the facts and circumstances of the case. The prayer

for bail is allowed.

Accordingly, the petitioner, namely, Sankar Pal @ Paul, is granted bail on condition that the petitioner shall furnish a bond of Rs.10,000/- (Rupees ten thousand) only with two sureties of like amount, one of whom must be local to the satisfaction of the learned ACJM, Serampore.

While on bail, the petitioner shall meet the Investigating Officer of the case once a week until further orders. CRM 7952 of 2021 is, thus, disposed of.
