Heard learned Advocates appearing for the parties. This writ petition has been filed by the petitioner being aggrieved by inaction on the part of the Income Tax Authorities concerned in refunding the payable amount as appears from the respondents' own computation dated 28th December, 2018, which appears from page 52 to the writ petition. It is the case of the petitioner that in spite of repeated representations before the respondent authority concerned, petitioner's claim of refund has not been considered and one of such representation is dated 10th February, 2020 being Annexure P-4 to the writ petition.

Considering the submission of the parties this writ petition, being WPA 19196 of 2021 is disposed of by directing the Principal Chief Commissioner of Income Tax, Burdwan Range/Respondent No.4 to consider and dispose of the petitioner's representation for

refund dated 10th February, 2020 in accordance with law and by passing a reasoned and speaking order and after taking into consideration the computation of the department dated 28th December, 2018 made by the ITO, Ward 1(3) on the basis of the assessment order under Section 143(3) relating to assessment year 201102012, positively within four weeks from the date of communication of this order along with statutory interest.
