Petitioner approached this Court with specific grievances.
After the order dated 02.12.2024 the CCTV footages and DVR which were installed in front of the flat and corridor maintained and monitored by the de facto complainant and her husband, in respect of the two pen drives were produced before the investigating officer. However, the DVR of the same was not produced. The investigating officer prayed before the learned CJM, Paschim Bardhaman for issuing notice to the de facto complainant and the next date has been fixed on 16.01.2025 for the purpose of getting certificate under Section 65B of the Evidence Act from the de facto complainant.
In view of the police authorities taking appropriate steps so far as investigation of the case is
concerned and the collection of the materials pursuant to the directions, the police authorities would submit their report of logical conclusion before the jurisdictional court.
So far as the other issues are concerned, police authorities would ensure that there is no breach of the peace at the premises concerned because of the inimical relationship existing between the petitioner and the private respondents. To that effect, police authorities would also keep a strict vigil. With the aforesaid observations, WPA 18931 of 2024 is disposed of.
There will be no order as to costs.
Report so submitted by the State be kept with the record.
A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
