The petitioner has filed this writ petition alleging that the private respondents are illegally running a sawmill without obtaining necessary licences. A Co-ordinate Bench of this Court by an order dated September 18, 2019 directed the respondent no.3 that is the Divisional Forest Officer, Nadia to visit the locale and make an inventory of the logs, if any, lying at the locale.

The State-Respondent was also directed to ensure that the sawmill is not operated in any manner without appropriate licence and permission.

Mr. Amitava Mitra, Learned Advocate led by Mr. Samrat Sen, Learned Senior Advocate, appears for the State and files a Report of the Divisional Forest Officer dated April 28, 2022 vide Memo No. 780/15-MDLR wherefrom it appears that the Divisional Forest Officer

forwarded the status report of the sawmill of Islampore Kaat Babsayee Kalyan Samitee at Goas, Murshidabad to the Chief Conservator of Forests.

From the status report dated April 28, 2022, it appears that the said sawmill was found in a closed condition as on April 28, 2022 upon an inspection carried out by the Range Officer, Behrampore South Range.

Since the sawmill is found to be in closed condition as indicated in the status report, this Court is of the view that the grievance of the petitioner has already been redressed.

Accordingly, WPA 17064 of 2019 stands disposed of.

There shall be, however, no order as to costs. Urgent photostat certified copy of this, if applied for, be given to the parties upon compliance with all necessary formalities.
