Nasir Sk @ Nasiruddin Sk. And ORS. v. State Of West Bengal
02.09.2025 Sl. No.44 NB CRM (A) 2806 of 2025 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure, 1973 corresponding to Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Rejinagar P.S. Case No.174/2025 dated 17.06.2025 under Sections 109/117(2)/118(2)/3(5)/324(4)/329(3) of the Bharatiya Nyaya Sanhita, 2023.
And In the matter of: Nasir Sk @ Nasiruddin Sk. & Ors. ... petitioners Mr. Tapodip Gupta.
...for the petitioners.
Mr. Sanjoy Bardhan, Mr. Arup Sarkar.
...for the State.
Ms. Dona Saha, Mr. Sahidur Rahaman.
...for the de facto complainant.
Learned counsel appearing on behalf of the petitioners submits as follows. The petitioners have been falsely implicated in this case. There are case and counter case. Both sides received injuries.
Learned counsel appearing on behalf of the de facto complainant strongly opposes the prayer for anticipatory bail. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. He refers to the statements of the injured and other witnesses. He also refers to the injury reports showing grievous injuries on many of the victims and in one case, there was fracture of frontal bone of the forehead and in another case, fracture of nasal bones.
Considering the above and the other incriminating materials available in the case diary and the alleged roles ascribed to the present petitioners, I do not consider this to be a fit case for granting anticipatory bail to the petitioners. The application for anticipatory bail being C.R.M. (A) 2806 of 2025 is, thus, rejected.
Urgent photostat certified copies of this order may be delivered to the learned Advocates for the parties, if applied for, upon compliance of all formalities.
