Learned counsel for the petitioner contends that the electricity connection to the petitioner's submersible pump has been given via bamboo poles, which is creating safety hazards. Such contention is denied by learned counsel for the West Bengal State Electricity Distribution Company Limited (WBSEDCL), who submits that the present writ petition has been filed to bypass a notice given by the WBSEDCL to the petitioner asking the petitioner to show cause as to why the petitioner has himself shifted the submersible pump and the related service connection around 200 meters from its original location in an unauthorised manner.

In any event, the representation annexed at page - 16 of the writ petition, which is the

alleged representation given by the petitioner for installation of permanent electricity poles, could not have been entertained by the WBSEDCL since it is not in proper format.

Hence, WPA No. 18517 of 2022 is disposed of by granting liberty to the petitioner to apply in appropriate format for shifting of the electricity meters from its original position in due course of law. If such an application is made, the WBSEDCL shall process the same and intimate the necessary expenses to the petitioner to enable the petitioner to put in such amount for the purpose of shifting the connection.

It is made clear that nothing in this order shall prevent the WBSEDCL from proceeding in due course of law against the petitioner for alleged unauthorised shifting of the electricity connection around 200 meters from its original location.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
