Judgment delivered in open Court vide separate sheets. Department is directed to ascertain from the concerned Correctional Home where the appellant was lodged to ascertain as to whether he has been released on bail. However, if he is still in custody, a copy of the judgment be immediately forwarded to Superintendent of the said Correctional Home. A copy of the judgment be sent to Secretary, Calcutta High Court, Legal Services Committee to do the needful in this regard. Fees as per scale be sanctioned in favour of Ms. Chandreyee Alam who was appointed as amicus curiae for the appellant by us in this case.
