It is further submitted that he is not the principal assailant. Learned Counsel appearing for the State opposes the prayer for bail.

We have considered the materials on record including the statement of the witness recorded under Sections 164 of the Code of Criminal Procedure. Petitioner was one of the members of the unlawful assembly, one of whom had shot at the deceased.

In view of prima facie involvement of the petitioner in the alleged crime, we are of the opinion that this is not a fit case to grant bail to the petitioner.

And In Re : Rabish Kumar Upadhyay ..... petitioner Mr. Asraf Ali ... for the petitioner Mr. Debojyoti Deb ... for the State Having considered the materials on record prima facie disclosing involvement of the petitioner in the alleged crime of misappropriation of monies of the innocent depositors and the fact that the petitioner has absconded for a protracted period of time, we are not inclined to grant bail to the petitioner at this stage.
