In this Public Interest Litigation (PIL), the petitioner has prayed for issuance of writ of Quo Warranto against the post of Chief Municipal Law Officer.

This point is no more res integra. The Hon'ble Apex Court, in the case of Hari Bansh Lal v. Sahodar Prasad Mahto & Ors. reported at (2010) 9 SCC 655 opined that Public Interest Litigation (PIL) cannot be entertained for issuance of writ of Quo Warranto.

Accordingly, PIL is dismissed by reserving liberty to the petitioner to avail the appropriate remedy, in accordance with law.
