Sarwar Jahan, Mr. Sayantan Hazra, Advocates ... for the respondent Nos.6, 7, & 8 In this public interest petition, the petitioner, who is an elected representative of Bakhrabad Gram Panchayat, has raised the grievance that the panchayat is floating tenders without following the requisite norms, rules and regulations and the malpractice and irregularities are done in the process of floating of tenders.

It is the submission of learned counsel for the petitioner that though repeated representations as enclosed with the writ petition were made but no action has been taken by the concerned authorities till now. Learned counsel for Bakhrabad Gram Panchayat has opposed the petition.

Learned counsel for the State fairly stated that if the petitioner files a representation to respondent No.2, then the grievance of the petitioner will be looked into. We are of the view that the grievance which is raised by the petitioner needs to be looked into by respondent No.2, District Magistrate, Malda Hence, we dispose of the present petition permitting the petitioner to file an appropriate representation before respondent No.2. On receipt of the same, respondent No.2 will give opportunity of hearing to the petitioner and all concerned parties and take appropriate decision in accordance with law as expeditiously as possible, preferably within a period of 3 months from the date of receipt of the representation.

Urgent certified copy of this order, if applied for, be made available to the parties upon compliance of requisite formalities.
