Report submitted by the learned advocate appearing for the State be also kept with the record. The petitioner, who is aged about 67 years, presently only restricts her prayer to stay at the residential house by waiving her right so far as other issues are concerned.

Learned advocate appearing for the private respondent nos. 6 and 7 submits that the ground floor of the residential house is vacant and there is no impediment, if the petitioner goes and stays over there.

State has submitted a report regarding the steps taken by the police authorities.

Since the dispute is absolutely a family dispute, the police authorities have their limitations

in exercising their powers. Accordingly, if the petitioner feels insecure, she would approach the police authorities who would provide a lady police constable as escort to the petitioner for entering the ground floor of the residential building. Every alternate day, the concerned lady police officer would visit and ensure whether the petitioner is subjected to any harassment/ill-treatment and thereafter, if she finds that there are circumstances which have been blown out of proportion, report to the Inspector-in-Charge, Panskura Police Station who would take steps in accordance with law. Such arrangement would continue for a period of four weeks.

In the meantime, the petitioner would approach the appropriate authority under the provisions of Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The concerned authority, if passes any direction upon the police authorities, the police authorities would respect, obey and implement such order.

With the aforesaid observations, the writ petition being WPA 18840 of 2024 is disposed of. There will be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
