Since the innocuous prayer of the petitioner is for expeditious disposal of execution case being MW/08/2023 pending before the learned Sub-Divisional Officer, Kakdwip, South 24 Parganas, the matter may be taken up for consideration without service of notice upon the opposite party.

The opposite party shall not be prejudiced by an order directing expeditious disposal of the case. This Court is informed that the petitioner filed an application before the learned Sub-Divisional Officer, Kakdwip seeking maintenance from his son/the opposite party under the Welfare of Parents and Senior Citizens Act, 2007 and by an order passed on 20th March, 2023, the Sub-Divisional Officer-Chairman, Maintenance Tribunal under the 2007 Act directed the opposite party to pay Rs.6,000/- per month to the petitioner through bank transfer.

Learned counsel submits that since the said order was not complied with by the opposite party, the petitioner filed the execution case which is still pending. The petitioner appears to be an octogenarian person. In view of the above, the Sub-Divisional Officer, Kakdwip, South 24 Parganas is directed to consider and dispose of the execution case being MW/08/2023 pending before him as expeditiously as possible, preferably within two months from the next date of hearing fixed before him without granting any unnecessary adjournment to either of the parties, in accordance with law.

The revisional application being CRR 3105 of 2024 is disposed of.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
