The writ application has been preferred praying for quashing the illegal grant of license of fair price shop (Ration shop) being FPS CodeWB0330413236, license no.33041322957 under vacancy ID: 202200219913 for the village of Balrampur, Bankur & Kamalpur (Central Location: Near Kamalpur Jr.High School), P.S.- Itahar, District- Uttar Dinajpur which was obtained by the private respondent no.13 fraudulently, misrepresenting his status over the property where his godown is constructed by using a forged deed.

It appears that the petitioner has preferred a representation on 17.07.2025, but the same has not been considered by the authorities till date. Considering the nature of dispute in the present case, which involves several State authorities/Depts and the materials on record, the writ application is disposed of with the direction, that the Respondent no.5, the District Controller Food & Supplies shall consider the representation of the petitioner, on hearing all the stake holders, and pass a reasoned order, in accordance with law within 60 days from the date of communication of this order.

The issues raised by the petitioner in the present case, has not been got into by this Court and as such the petitioner shall be at liberty to raise the said issues before the authority concerned. The writ application stands disposed of.

Applications, if any, connected thereto stand disposed of consequently.

Interim order, if any, stands vacated.

Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
