The respondent authorities have filed the report stating that to avoid ambiguity or future contractual complications, the railways administration has decided to discharge both the tenders being NIT Nos. 61245449B and 61245471C. 2.

Learned counsel for the petitioners submits that in future the respondents may use the drawing and designs of the petitioners and may not exclude the component type Heat Treated Welded (HTW) crossing in future tender and prayed for a direction upon the respondents not to use the design and drawing of the petitioners and not to exclude the component type Heat Treated Welded (HTW).

This Court finds that the petitioners have filed the present writ application challenging the tenders issued by the authorities and now the authorities have withdrawn the said tender. On the basis of apprehension no order can be passed.

This Court finds that the authorities have already discharged both NITs, there nothing remains in the present writ application.

Accordingly, WPA 18021 of 2025 is disposed of. 6.

As the authorities have discharged both the tenders, this Court has no opportunity to go into the merit of the case. (Krishna Rao, J.)
