Petitioner is aggrieved by the fact that in spite of information regarding the disturbance, interference and obstruction created by the private respondents furnished to the police authorities, no steps were taken.

Learned advocate appearing for the petitioner draws the attention of the Court to the accusations made to the police authorities regarding assault, outraging of modesty and trespass into the property of the petitioner.

State has submitted a report which reflects that there was a dispute relating to the land. There was measurement of the said land on 16.08.2025 and the petitioner is presently in possession of the property.

So far as the accusations relating to assault, outraging modesty and criminal trespass are concerned, no case till date has been initiated by the police authorities. There is a grievance to such aspect. Having considered the same, I am of the opinion that petitioner should approach the learned jurisdictional Magistrate under the relevant provisions of law. Learned Magistrate would assess and ascertain regarding the nature of the accusations and thereafter pass necessary orders as he deems fit and proper.

Police authorities are well aware regarding the present scenario at the ground reality, as such they would ensure that there is no violation of law and order and take steps in accordance with law. With the aforesaid observations, the writ petition being WPA 18099 of 2025 is disposed of. There will be no order as to costs.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
