1. Heard learned Counsel for the parties.

2. Except delay in lodging of the report referred to the P.S. under Section 156(3) Cr.P.C. and non-explanation for the same, there is nothing on record to cast any motive on the part of the victim to falsely implicate the present petitioner who is stated to be the friend of the husband of the victim and a stranger to the matrimony between the victim and her husband (co-accused).

3. Regard being had to the gravity of the offence and seriousness of the charge, we are not inclined to exercise our discretion under Section 438 Cr.P.C. in favour of the petitioner.

4. Accordingly, the prayer for anticipatory bail is rejected.
