Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused there is no other incriminating material available against the present petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail. She submits that there is another criminal antecedent of the petitioner involving NDPS Act. The phone call records could not be traced as the mobile phone of the petitioner could not be seized.

Considering the incriminating materials available in the case diary, the criminal antecedent of the petitioner and the restriction contained in Section 37 of the NDPS Act, I am not inclined to grant anticipatory bail to the petitioner.

Accordingly, the application for anticipatory bail is rejected. (Jay Sengupta, J.)
