Kausik (Rejected) CRM (NDPS) 989 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with NCB Crime No. 27/2023 dated 05.09.2023 under Sections 21(c)/25/28/29 of the NDPS Act;

Learned advocate appearing for the petitioner submits that although 6363 bottles of Pheysedyl were recovered but the petitioner is innocent and has been implicated on the basis of statement of co-accused.

Learned advocate for the NCB on the other hand produces the seizure list, draws the attention of the Court and submits that the petitioner is the owner of the godown and the other co-accused is also associated with him. Having considered that huge quantity of contraband was recovered in the present case, the issues canvassed by the petitioner are purely questions of facts to be decided in course of trial. As such, at this stage, I am not inclined to release the

petitioner on bail as the rigors of section 37 of the NDPS Act is attracted.

Consequently, CRM (NDPS) 989 of 2025 is dismissed. Report submitted by the NCB be kept with the record. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
