Mr. Ranjan Kali Ms. Mili Saha ..... for the petitioners Mr. Prabir Banerjee ....for the respondent Nos. 1 & 2 The petitioners have filed supplementary affidavit for bringing on record an application filed by the petitioners before DRT on 31st August, 2022 challenging the e-auction sale notice of 22.07.2022. This is also the prayer in the present writ petition.

A Notification has however been circulated in the meantime by the DRT by which the Presiding Officer of DRT-I is to take up the matters of DRT-III. Since learned counsel appearing for the respondent Bank submits that the sale which was scheduled for 31st August, 2022 could not be given effect to by reason of an insufficient number of bidders, nothing further remains in the writ petition which has become infructuous. The respondent Bank shall however give advance notice of seven days to the petitioners before proceeding with a fresh notice of sale of the property. WPA 18536 of 2022 is disposed of in terms of the above.

The petitioners shall have liberty of approaching the DRT-I for urgent relief.
