Mr. Mit Guha Roy ... For the Respondent Nos.4 &5. The order dated 26.09.2024 passed by the co-ordinate Bench reflects that Patuli PS Case No.335 dated 24.09.2024 was registered for investigation. Earlier there was a direction to submit a progress report.
Learned advocate appearing on behalf of the respondent nos. 4 and 5 submits that charge-sheet has been submitted in the meantime in connection with Patuli PS Case No.335 dated 24.09.2024.
However, the learned advocate appearing for the State is unable to apprise the progress of the investigation.
Having considered that the case was instituted on September, 2024 and the accusations which are made are in addition to the steps proposed to be taken by the investigating agency, sufficient time has lapsed in the meantime. In case the police authorities could not conclude the investigation within 11 months, I am of the view that in another 30 days, police authorities would
conclude the investigation, take necessary steps and inform the learned Magistrate who is in seisin of Patuli PS Case No.335 dated 24.09.2024. In the alternative, if the charge-sheet has already been submitted before the jurisdictional court, petitioners would ventilate their grievance before the jurisdictional court if they are dissatisfied with the investigation or necessary issues in respect of which the investigation was not done by the police authorities.
With the aforesaid observations, the writ petition being WPA 18914 of 2024 is disposed of. Pending connected application, if any, is consequently disposed of.
There will be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
