The petitioners have submitted the attendance endorsements in compliance with the order passed on 22nd August, 2023. They have assailed the order passed by the learned Additional District and Sessions Judge, Fast Track, 1st Court, Basirhat, North 24 Parganas passed on 6th July, 2023 in Criminal Revision No.50 of 2022 affirming the order passed by the Additional Chief Judicial Magistrate, Basirhat declaring the petitioners as proclaimed offenders with an observation " case is filed for the present".
It appears that warrant of proclamation and attachment was issued against the petitioners on 8th August, 2022 and they were declared proclaimed offenders on 19th September, 2022.
It appears that the order impugned was passed in accordance with law and there is no illegality and/or irregularity in the impugned order which requires interference by this Court.
The petitioners are directed to surrender before the learned Trial Court by 5th July, 2024. In the event the petitioners surrender by the said date and apply for bail, the learned Trial Court shall deal with the same, in accordance with law.
In view of the above, the application being CRR 2808 of 2023 is disposed of.
The order impugned dated 6th July, 2023 passed by the learned Additional District and Sessions Judge, Fast Track, 1st Court, Basirhat, North 24 Parganas in Criminal Revision No.50 of 2022 be stayed till 5th July, 2024. Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
